The present paper revisits the issue of rational decision making in John Rawls' original position. Drawing on Isaac Levi's theory of decision, I discuss how we can defend Rawls against John C. Harsanyi's charge that maximin reasoning in the original position is irrational. The discussion suggests that systematic application of Levi's theory is likely to have important consequences for ethics and political theory as well as for public policy.

The issue of how to justify right and wrong is a recurring methodological problem in ethics. We can, somewhat simplified, distinguish between people who argue that right and wrong must be confirmed by our moral convictions and people who maintain that morality must be justified by principles independent from these convictions. The issue hinges on arriving at a standard or criterion for when something is right or wrong. The author discusses this issue in light of the distinction between perfect procedural (...) justice and pure procedural justice, drawing on the works of John Rawls and Peter Singer. One shortcoming affecting both these approaches is how they are unable to account for our basic beliefs. Using Ludwig Wittgenstein’s On Certainty as a point of departure, the author attempts to demonstrate that some of our basic beliefs cannot be formulated in propositions, but rather are expressed by our actions. The author concludes that we, in light of this, must distinguish between our ethical propositions and our basic beliefs. The former may be subject to doubt and may, consequently, be expressed in the form of propositions, whereas the latter is only expressed by what we say and what we do. (shrink)

This paper argues that the idea of creative destruction enters the social sciences by way of Friedrich Nietzsche. The term itself is first used by German economist Werner Sombart, who openly acknowledges the influence of Nietzsche on his own economic theory. The roots of creative destruction are traced back to Indian philosophy, from where the idea entered the German literary and philosophical tradition. Understanding the origins and evolution of this key concept in evolutionary economics helps clarifying the contrasts between today’s (...) standard mainstream economics and the Schumpeterian and evolutionary alternative. Learned, exigent, original, and timely, Erik Roraback's The Power of the Impossible: On Community and the Creative Life presents authoritative readings of what important theorists from Spinoza to Bataille, Blanchot, Nancy, Žižek, and others have had to say about community and the individual, with sections along the way on how those theorists might lead us to approach work by Henry James, James Joyce, Ralph Ellison, Dante Alighieri, and, surprisingly, the great tennis player, Ivan Lendl. Roraback also develops on the (...) basis of his theorists his own persuasive concept of an impossible/possible global community yet to come that would facilitate individual creativity as well as contest the repressive hegemony of finance capitalism and technology, especially digital technology. This paper argues in favor of a hybrid conception of identity. A common conception of identity in datafied society is a split between a digital self and a real self, which has resulted in concepts such as the data double, algorithmic identity, and data shadows. These data-identity metaphors have played a significant role in the conception of informational privacy as control over information—the control of or restricted access to your digital identity. Through analyses of various data-identity metaphors as well as (...) philosophical accounts of identity, we argue in favor of a hybrid conception of identity that emphasizes the relations between the ‘real’ and the ‘digital’. A hybrid conception of identity—where the digital is an aspect on par with social relations, self-understanding, and values—ultimately calls for an understanding of privacy as the right to influence one’s own identity. The earlier volume in this series dealt with two religions of Indian origin, namely, Buddhism and Jainism. The Indian religious scene, however, is characterized by not only religions which originated in India but also by religions which entered India from outside India and made their home here. Thus religious life in India has been enlivened throughout its history by the presence of religions of foreign origin on its soil almost from the very time they came into existence. This volume covers (...) three such religions—Zoraoastrianism, Judaism, and Islam. In the case of Zoraostianism, even its very beginnings are intertwined with India, as Zoroastrianism reformed a preexisting religion which had strong links to the Vedic heritage of India. This relationship took on a new dimension when a Zoroastrian community, fearing persecution in Persia after its Arab conquest, sought shelter in western India and ultimately went on to produce India’s pioneering nationalist in the figure of Dadabhai Naoroji ( 1825-1917), also known as the Grand Old Man of India. Jews found refuge in south India after the destruction of the Temple by the Romans in 70 C.E. and have remained a part of the Indian religious scene since then, some even returning to Israel after it was founded in 1948. Islam arrived in Kerala as soon as it was founded and one of the earliest mosques in the history of Islam is found in India. Islam differs from the previously mentioned religions inasmuch as it went on to gain political hegemony over parts of the country for considerable periods of time, which meant that its impact on the religious life of the subcontinent has been greater compared to the other religions. It has also meant that Islam has existed in a religiously plural environment in India for a longer period than elsewhere in the world so that not only has Islam left a mark on India, India has also left its mark on it. Indeed all the three religions covered in this volume share this dual feature, that they have profoundly influenced Indian religious life and have also in turn been profoundly influenced by their presence in India. Since the start of the program to investigate the ethical, legal, and social implications (ELSI) of the Human Genome Project in 1990, many ELSI scholars have maintained that genetic testing should be used with caution because of the potential for negative psychosocial effects associated with receiving genetic information. More recently, though, some ELSI scholars have produced evidence suggesting that the original ELSI concerns were unfounded, exaggerated, or, at a minimum, misdirected. At least in the contexts that have been most studied, (...) large negative impacts have not been found in the vast majority of people studied. What might explain the discrepancy between the original hypothesized outcomes and the growing impression that large negative effects appear to be few and far between? And if the original predictions of large negative psychosocial effects were simply wrong, is it time for ELSI researchers to move on? Should genetic testing be routinized, and would it be appropriate to relax or abandon the practice of engaging patients in a process of detailed informed consent before they receive genetic information? To confront those questions, we convened a conference entitled “Looking for the Psychosocial Impacts of Genomic Information” to review what is known about the negative impacts of genetic information on a variety of populations and in multiple medical and social contexts, to explore the implications of the findings, and to consider whether future research might benefit from different methods than have been used to date. Contemporary privacy theories and European discussions about data protection employ the notion of ‘personal information’ to designate their areas of concern. The notion of personal information is demarcated from non-personal information—or just information—indicating that we are dealing with a specific kind of information. However, within privacy scholarship the notion of personal information appears undertheorized, rendering the concept somewhat unclear. We argue that in an age of datafication, protection of personal information and privacy is crucial, making the understanding of what is (...) meant by ‘personal information’ more important than ever. To contribute to this aim, we analyse the conception of personal information and its nature, including the distinction between personal and non-personal information from a philosophy of language perspective. Through analyses of aboutness and relative aboutness we point to challenges related to the demarcation between personal and non-personal information, which may in practice lead to all information being personal. Background Over the last years, there has been a growth in care solutions aiming to support home-dwelling persons with dementia. Assistive technology and voluntarism have emerged as supplements to traditional homecare and daycare centers. However, patient participation is often lacking in decision-making processes, undermining ethical principles and basic human rights. Research objective This study explores the perceptions of persons with dementia toward assistive technology, volunteer support, homecare services, and daycare centers. Research design A hermeneutical approach was chosen for this study, (...) using a semi-structured interview guide to allow for interviews in the form of open conversations. Participants and research context Twelve home-dwelling persons with dementia participated in the study. The participants were recruited through municipal daycare centers. Ethical considerations Interviews were facilitated within a safe environment, carefully conducted to safeguard the participants’ integrity. The Regional Committee for Medical and Health Research Ethics, Western Norway (Project number 2016/1630) approved the study. Findings The participants shared a well of reflections on experience and attitudes toward the aspects explored. They described assistive technology as possibly beneficial, but pointed to several non-beneficial side effects. Likewise, they were hesitant toward volunteer support, depending on how this might fit their individual preferences. Homecare services were perceived as a necessary means of care, its benefits ascribed to a variety of aspects. Similarly, the participants’ assessments of daycare centers relied on specific aspects, with high individual variety. Discussion and conclusion The study indicates that the margins between whether these specific care interventions were perceived as supportive or infringing may be small and details may have great effect on the persons’ everyday life. This indicates that patient participation in decision-making processes for this group is—in addition to be a judicial and ethical requirement—crucial to ensure adequate care and support. (shrink)

This volume collects twenty original essays on the philosophy of film. It uniquely brings together scholars working across a range of philosophical traditions and academic disciplines to broaden and advance debates on film and philosophy. The book includes contributions from a number of prominent philosophers of film including Noël Carroll, Chris Falzon, Deborah Knight, Paisley Livingston, Robert Sinnerbrink, Malcolm Turvey, and Thomas Wartenberg. While the topics explored by the contributors are diverse, there are a number of thematic threads that connect (...) them. Overall, the book seeks to bridge analytic and continental approaches to philosophy of film in fruitful ways. Moving to the individual essays, the first two sections offer novel takes on the philosophical value and the nature of film. The next section focuses on the film-as-philosophy debate. In a recent article in this journal, Eli Pitcovski puts forward a novel, explanation-based account of harm. We seek to show that Pitcovski’s account, and his arguments in favor of it, can be substantially improved. However, we also argue that, even thus improved, the account faces a dilemma. The dilemma concerns the question of what it takes for an event, E, to explain why a state, P, does not obtain. Does this require that P would have obtained if E had (...) not occurred? Pitcovski’s theory faces problems no matter how one answers that question. (shrink)

In recent years, it has become commonplace among the Global Burden of Disease study authors to regard the disability-adjusted life year primarily as a descriptive health metric. During the first phase of the GBD, it was widely acknowledged that the DALY had built-in evaluative assumptions. However, from the publication of the 2010 GBD and onwards, two central evaluative practices—time discounting and age-weighting—have been omitted from the DALY model. After this substantial revision, the emerging view now appears to be that the (...) DALY is primarily a descriptive measure. Our aim in this article is to argue that the DALY, despite changes, remains largely evaluative. Our analysis focuses on the understanding of the DALY by comparing the DALY as a measure of disease burden in the two most significant phases of GBD publications, from their beginning to the most recent releases. We identify numerous assumptions underlying the DALY and group them as descriptive or evaluative. We conclude that while the DALY model arguably has become more descriptive, it remains, by necessity, largely evaluative. (shrink)

The Radical Enactive/embodied view of Cognition, or REC, claims that all cognition is a matter of skilled performance. Yet REC also makes a distinction between basic and content-involving cognition, arguing that the development of basic to content-involving cognition involves a kink. It might seem that this distinction leads to problematic gaps in REC’s story. We address two such alleged gaps in this paper. First, we identify and reply to the concern that REC leads to an “interface problem”, according to which (...) REC has to account for the interaction of two minds co-present in the same cognitive activity. We emphasise how REC’s view of content-involving cognition in terms of activities that require particular sociocultural practices can resolve these interface concerns. The second potential problematic gap is that REC creates an unjustified difference in kind between animal and human cognition. In response, we clarify and further explicate REC’s notion of content, and argue that this notion allows REC to justifiably mark the distinction between basic and content-involving cognition as a difference in kind. We conclude by pointing out in what sense basic and content-involving cognitive activities are the same, yet different. They are the same because they are all forms of skilled performance, yet different as some forms of skilled performance are genuinely different from other forms. (shrink)

Can appealing to children’s rights help to solve the non-identity problem in cases of procreation? A number of philosophers have answered affirmatively, arguing that even if children cannot be harmed by being born into disadvantaged conditions, they may nevertheless be wronged if those conditions fail to meet a minimal standard of decency to which all children are putatively entitled. This paper defends the tenability of this view by outlining and responding to five prominent objections that have been raised against it (...) in the contemporary literature: the identifiability objection; the non-existence objection; the waiving of rights objection, the lack of legitimate complaint objection; and the unfairness objection. The advent of new technologies has rekindled some hopes that it will be possible to identify genetic variants that will help to explain why individuals are different with respect to complex traits. At least one leader in the development of “whole genome sequencing”—the Chinese company BGI—has been quite public about its commitment to using the technique to investigate the genetics of intelligence in general and high intelligence in particular. Because one needs large samples to detect the small effects associated with (...) small genetic differences in the sequence of those base pairs, to make headway with the new sequencing technologies, one also needs to enlist much larger numbers of study participants than geneticists have enrolled before. In an effort to increase the size of a sample, one team of researchers approached the Center for Talented Youth at Johns Hopkins University. They wanted to gain access to records concerning participants in CTY's ongoing Study of Exceptional Talent, and they wanted to approach those individuals to see if they would be willing to share samples of their DNA.We agreed that CTY's dilemma about whether to give the researchers access to those records raised larger questions about the ethics of research into the genetics of intelligence, and we decided to hold a workshop at The Hastings Center that could examine those questions. Our purpose was to create what, borrowing from Sarah Richardson, we came to call a “transformative conversation” about research into the genetics of general cognitive ability—a conversation that would take a wide and long view and would involve a diverse group of stakeholders, including both people who have been highly critical of the research and people who engage in it. This collection of essays, which grew out of that workshop, is intended to provide an introduction to and exploration of this complex and important area. (shrink)

Genomic research—including whole genome sequencing and whole exome sequencing—has a growing presence in contemporary biomedical investigation. The capacity of sequencing techniques to generate results that go beyond the primary aims of the research—historically referred to as “incidental findings”—has generated considerable discussion as to how this information should be handled—that is, whether incidental results should be returned, and if so, which ones.Federal regulations governing most human subjects research in the United States require the disclosure of “the procedures to be followed” in (...) the research as part of the informed consent process. It seems reasonable to assume—and indeed, many commentators have concluded—that genomic investigators will be expected to inform participants about, among other procedures, the prospect that incidental findings will become available and the mechanisms for dealing with them. Investigators, most of whom will not have dealt with these issues before, will face considerable challenges in framing meaningful disclosures for research participants.To help in this task, we undertook to identify the elements that should be included in the informed consent process related to incidental findings. We did this by surveying a large number of genomic researchers (n = 241) and by conducting in‐depth interviews with a smaller number of researchers (n = 28) and genomic research participants (n = 20). Based on these findings, it seems clear to us that routine approaches to informed consent are not likely to be effective in genomic research in which the prospect of incidental findings exists. Ensuring that participants’ decisions are informed and meaningful will require innovative approaches to dealing with the consent issue. We have identified four prototypical models of a consent process for return of incidental findings. (shrink)

In this consensus report by a diverse group of academics who conduct and/or are concerned about social and behavioral genomics (SBG) research, the authors recount the often‐ugly history of scientific attempts to understand the genetic contributions to human behaviors and social outcomes. They then describe what the current science—including genomewide association studies and polygenic indexes—can and cannot tell us, as well as its risks and potential benefits. They conclude with a discussion of responsible behavior in the context of SBG research. (...) SBG research that compares individuals within a group according to a “sensitive” phenotype requires extra attention to responsible conduct and to responsible communication about the research and its findings. SBG research (1) on sensitive phenotypes that (2) compares two or more groups defined by (a) race, (b) ethnicity, or (c) genetic ancestry (where genetic ancestry could easily be misunderstood as race or ethnicity) requires a compelling justification to be conducted, funded, or published. All authors agree that this justification at least requires a convincing argument that a study's design could yield scientifically valid results; some authors would additionally require the study to have a socially favorable risk‐benefit profile. In this original and controversial book Professor Rawls argues that Durkheim's The Elementary Forms of Religious Life is the crowning achievement of his sociological endeavour and that since its publication in English in 1915 it has been consistently misunderstood. Rather than a work on primitive religion or the sociology of knowledge, Rawls asserts that it is an attempt by Durkheim to establish a unique epistemological basis for the study of sociology and moral relations. By privileging social practice over (...) beliefs and ideas, it avoids the dilemmas inherent in philosophical approaches to knowledge and morality that are based on individualism and the tendency to privilege beliefs and ideas over practices, both tendencies that dominate western thought. Based on detailed textual analysis of the primary text, this book will be an important and original contribution to contemporary debates on social theory and philosophy. (shrink)

Arlie Russell Hochschild is Professor Emerita of Sociology at the University of California, Berkeley. Her books include: The Managed Heart (1983), The Second Shift (1989), The Time Bind (1997) and The Commercialization of Intimate Life (2003). In her work, Hochschild explores the many ways we manage our emotions in personal life and perform emotional labor in the workplace. Her most recent work explores the growing political divide in America, and the need for each side to climb an ‘empathy wall’ to (...) begin dialogue with those on the other side. She reports on five years of field-work among Tea Party enthusiasts in Louisiana in her latest book, Strangers in Their Own Land: Anger and Mourning on the American Right (2016). In this interview, she reflects on the phenomenon of critique within the framework of emotional labor, which leads to discussions on neoliberalism and the ideal worker in contemporary working life. A full appreciation for Ernst Mach's doctrine of the economy of thought must take account of his direct realism about particulars (elements) and his anti-realism about space-time laws as economical constructions. After a review of thought economy, its critics and some contemporary forms, the paper turns to the philosophical roots of Mach's doctrine. Mach claimed that the simplest, most parsimonious theories economized memory and effort by using abstract concepts and laws instead of attending to the details of each individual event (...) or experiment. For Mach, the individual case never truly repeated in all of its uniqueness, nor was all of the individual detail of a physical element adequately captured in abstract laws and schemata, however necessary these were for the pursuit of science. As can be shown from specific passages, some already published, some not, Mach's elements included physical qualia in nature similar to Russell's unsensed sensibilia, which existed even where there were no conscious observers. An argument will be presented to make the case that Mach believed in the mind-independent elements from the 1870s on, while other aspects of his thought evolved over time; I have thus dated the references to reflect this historical progression. I concentrate on Mach's ontology, as it bears on economy of thought, not his epistemology per se, which might well have been restricted to observable elements/sensations. After his own conversion to neutral monism, in the 1920s, Bertrand Russell echoed Mach's call for a 'future science' capable of handling the 'intrinsic character' of qualitative data directly without the excessive abstraction of physics. The situationally disqualifying ad hominem attack is an argumentative move in critical dialogue whereby one participant points out certain features in his adversary's personal situation that are claimed to make it inappropriate for this adversary to take a particular point of view, to argue in a particular way, or to launch certain criticisms. In this paper, we discuss some examples of this way of arguing. Other types of ad hominem argumentation are discussed as well and compared with the situationally disqualifying (...) type. The socalled Houtlosser Dilemma highlights the danger of unconditionally condoning ad hominem arguments. We propose a classification of ad hominem, and a more restrictive use of the term 'circumstantial'. Finally, we discuss whether ad hominem arguments are (always?) to be rejected as fallacious. This book demonstrates how Heidegger's departure from ontotheology occurs initially as a preparation for the concept of Dasein's transcendence and subsequently as its explicit development and overcoming. Dasein's transcendence is revealed as the foundation for the subsequent concept of Beyng as an Event, which stands in contrast to all ontotheological perspectives that assert a singular a priori foundation of the universe attributed to beings, God, consciousness, or even an independent "process" of Being that doesn't rely on Dasein. The book illustrates (...) that transcendence is not an attribute of human consciousness or a connection to something external to it. Instead, as a "primal act," transcendence paves the way for a non-representational dwelling in the essence of a historically unfolding Being, a contemplative recollection of the truth of Beyng. Throughout the book, there is a gradual progression towards an understanding of transcendence as an active engagement, wherein we "do" transcendence. This process involves a reconstruction of the ontological significance of action, emphasizing its performative embeddedness in existence and its inseparability from Beyng. (shrink)

Making way—and away.Asking after the state of movement may be less about the pause of cataloguing than the open that appears with being still, making a way of moving without movement, for a moment—to reflect on our understanding of the modes, manners, grammars, and vocabularies of movement and to speculate on the experience and so, in some basic sense, the assumption of movement, the line between those movements that remain in the background, out of view and taken for granted, often in the name of being able to simply get on with things, and those that provoke, invite, and disturb inquiry. If, for instance, the sort of movement named a “journey” is a long-standing and basic feature of the human condition (one can think variously, of better and much worse instantiations, from the Odyssey to the bloody quests for “salvation” that might have but mostly didn’t hinge on the air speed velocity of an unladen swallow to the Trail of Tears and Middle Passage to the moon shots), what’s happening in an American culture currently besotted with the idea of “being on a journey”—of discovery, fitness, creativity, acceptance, recovery, parenthood, leadership, home ownership, and so on and so forth.
